    I am facing a problem that I purchased a Intex I-Buddy Connect tablet and after 5 days I found its showing problem I went to service station they exchanged with a new one and again when I found it is defective in the same time they exchanged with a new one but that new one also found defect. 3 times they changed but all the three times I found it is defect after that they take some extra amount and give me a Intex Aqua 5.0 smartphone but sir again that phone also I found defect and when I complain they exchanged with a new one sir I am facing this problem from last 4 months when I told them kindly refund back my money I am not interested with your product they told me that we can refund your money we can only repair your phone as much time it showing defect. Sir again and again they are repairing and my all no are I have to feed. Sir Now I am really fed up and want to put a consumer complain can I put a consumer complaints regarding this.

    Sir,
    I am an office bearer of the Apartment owner’s welfare Association.(200 Flats in Bangalore.)
    The builder has encroached in the other survey land number ,built and completed the apartments.
    It is partly government land and part a private land.
    Will Consumer court accept the complaint for rectification and regularization of the sale deed title already given to us.( where only one survey land number appears)

    I read your article about consumer court. I want to know if this case falls under consumer court category.

    A 30*40 plot was purchased by my parents from D group society about 10-15 yrs ago, for which all the relevant documents are with us. Now, since the land value has grown up and Bangalore is fast developing, the same D group president and his associates are planning to grab everybody’s plot,(around 40 -50 sites) together and they have painted the allotted site numbers and are planning to give the sites new numbers and dispose it for others.

    Here, since we are the consumers and the trouble is being created by the same people who had sold that piece of plot to us, will I be able to challenge them in consumer court or should we go for civil and taken an injunction order.

    Also, will we be able to file cases in both civil as well as consumer court?
    Will the justice got through consumer court be recognised as par with the civil courts?

    Kindly answer to these queries, it will help us in a great way.

    Dear Sir,

    I wish to file a consumer complaint against Samsung India. In short, the display panel of the tv went off after 1.4 years of purchase. It is out of warranty by just 4 months. The cost of repairs is almost half the cost of tv paid last year.

    I am not sure if we could stand this case as the warranty period is over.

    I would be very grateful if you could guide and provide your opinion in this regard.

    I have given one mobile to repair at authorized repair center. It has been more than 10 month now and I haven’t received my mobile back. Whenever I have visited the shop I got assurance that they will give my mobile back in good condition in week time but not received my mobile yet. It has happen 5 times till date.
    Please suggest what to do. How do I receive my mobile back? Can I register a case in consumer court?

    Dear Sir,

    I had to file a complaint against a car dealer for delay in delivery even after taking full payment. But car is purchased under company owned car scheme in which 60% payment is made by me and 40 % made by company but car is not registered in my name but in company’s name but its for my use only not for company’s common use and after certain period it will be transferred to my name. Can I lodge complaint in consumer court.

    I have bought new ford figo car from ‘Lathangi Ford Bangalore’.Last few month there have been noise problem with car doors. So they fixed several times but it keeps on coming. So I have checked with Ford india for permanent solution as it keeps on coming and they suggested me to check with Lathangi ford manager. So I have parked my car in lathangi ford workshop and given clear instruction not fix this noise problem until you provide permanent solution. But without informing me he has fixed this problem and asking me to pick the vehicle. But I asked him why you have fixed without giving any solution and without informing me. My car in workshop last 20 days now they are not picking my call also.

    Three months ago i buyed an accident insurance policy from icici lombord by telephonic mode. But i did not recieved documents for that ! they promised to deliver document within 7 days but its 3 months. i called them many times but nothing happened. Can i file a complaint for this ? if yes then how ?

    Dear Sir,

    I had purchased a flat in the year 2010 and the builder had sold a car parking to me in 50000 Rs. Till date he has not allotted the parking to me. I am the only flat owner who had purchased an individual parking. We have visited his office multiple times in the past years and he always said that he will do the allotment soon. From last six months the situation has gone worse. He gives vague answers like “Paint your name on any parking you want”, “Go and talk to Mr X from his office”. I am just getting bounced from here and there and it seems he is just making fun of me. I told him that it is he who is supposed to paint my flat number on the parking as if I do it other flat owners will raise objection. He just shows disrespect when even ever we go and treats as if I am a beggar. The situation is so bad that I need to park my vehicle outside as the parking is always full with vehicles of other flat owners.

    Till date even the MSEB electricity meter is not transferred to my name. We have given the affidavit twice to him and still it is not done. He has started giving answers like “do it on your own and I will give you the expense”. I have been telling him that it is his duty to get the meter transferred.

    Please suggest whether I could file a consumer complaint against the builder. I do not want the parking now and I want him to be charged a fine of Rs 20 lakhs for the same so that in future he does not trouble any customer. Also will I get any protection in case the builder threatens me after filling complaint? I have an allotment letter for my parking on his letter head.

I have a grievance against the Mumbai based builder on deficiency of service as he took application money 20% without obtaining necessary permissions and now delaying registration on the pretext that certain approvals are forthcoming from district authorities.     Sir, I need your views… I had purchased a Nokia lumia 630 for my son on 24/05/14 as a gift as he secured 9.6/10 in his Xth exam. Less than 40 hours of purchase the mobile slipped from the sofa where he had kept it and the display glass cracked just like the glass of a car when it meets with an accident. Nokia is indifferent/insensitive to my grievance of getting the display glass changed. My son has not been able to download games also. The product I believe is defective and should be replaced. I am a middle class working woman and I have been told that it will cost Rs.3000/- to replace it which I cannot spend. Nokia claims that the display glass is Gorilla glass, then how come it broke so easily. Can I approach the Consumer Forum for redressal? How much will I have to spend if I approach the Forum? Pls. help. My son has lost his smile since then. Moreover the Sim card also has been cut to accomodate in the new mobile. I am unable to use the Sim also since then. Pls advise. Regards

    Hello Sir,
    I looking forward to file a complaint against Axis Bank, so i would like to know if my case comes under the category to file in Consumer Forum .
    Actually i am right now residing in US ( actually been here for Education ). Recently i have placed an order in ” Amazon ” (e-commerce company) to buy a Laptop which was costing $700, but as soon as i placed the order i realized that its the wrong product that i immediately cancelled it (within 5 mins) and also got a mail from Amazon saying that the product has been cancelled with no charges. But actually Axis Bank ( where i am holding my A/c) has debited the amount. I sent mails to Amazon to resolve this issue and they told that they are not holding the funds with then since the product has been cancelled and not shipped, but the representatives of axis bank told me to get a Authorized letter from the Dealer (where there is no dealer since there is no product sent to me) saying that they didnt receive any amount. The Amazon executive has provided me with the Transaction Id along with Authorization Number saying that they didnt receive any amount, but Axis bank is procrastinating the issue and saying that it will automatically be reverted back after 30 days. (Where the amount was debited on May 29,2014).
    Now i again faced the similar problem, where i actually placed an order of a book costing $20 but Axis Bank has deducted $250 making my A/c to Zero Balance, and the paradox is that Amazon has kept my order in-hold saying that there are no enough funds in the A/c to confirm the order. I again called Amazon and they told me that they haven’t received any amount (Where they said that they actually 1st ask for Authorization of the bank to check for availability of funds and later they confirm the order).

    So right now $950 has been blocked and its very hard for me to meet my needs. Can you kindly help me out with this issue whether i could file a case or not in India.

    Dear Sir, I seek an advise on my case as briefed below:

    One of the India’s finest fitness chain has fooled around 200 members in New Delhi. The franchise who has common board members and shares in Principle company and franchise itself, has charged huge amounts from its members against annual membership scheme and intimated the members in a sudden notice on closure of its branch after 3 months time. When we requested to update on refunds, repeatedly we have been receiving excuses to hold for some days, but no clarity on timelines. even we have been denied our payment receipts against made deposits. Fitness center premises are open everyday with no attention from its staff and management. In this case can i file a case under consumer court? Since police denies to take action under operational premises. We sent memo’s to boards and write numerous emails, with no replies.     I have small query. If i appoint advocate for fighting case in consumer forum, do i have to be present, while i have to file a case?

    Actually, I have given money to advocate, his behavior suddenly change after the cheque pass from my account to his. He has made wrong draft & forcing me to sign on it saying & also saying no need to come to consumer court, He will do it. When i said will i get acknowledgement receipt of the case from consumer court he said court don’t give any acknowledgement.
    I don’t believe on his saying & that why not signed a draft made by him.. I just want to know what he said is true or not?

    Dear Sir,

    I need your suggestion for the complaint (Servicing of Videocon TV) as mentioned below :
    On our query in the website, M/s CYBORG Technologies of Kolkata contacted us for the servicing of our Videocon TV (Colour, 21”) on 10th January, 2014 and complaint no. was given V10011405973.
    On 10th January, 2014 Technician of CYBORG Technologies inspected and given a report and taken the PCB for replacement of the EHT and estimated a cost of Rs. 1600/- including Service Charge.
    On 15th January, 2014 the PCB was returned with a new EHT for which only one month warranty was there as per the handwritten text in the invoice. No warranty paper was given. We paid Rs. 1600/- as per the Bill no. 3461. TV was running fine.
    On 6th June, 2014 we booked a complaint again to CYBORG for the same problem faced on earlier . The complaint No. was 06061406452. On 7th June, 2014 Technician visited and taken the PCB & hand remote for servicing in the service centre of CYBORG Technologies and estimated a cost of Rs. 1600/- as per Bill No. 4203 for the replacement of the EHT. It was replaced but TV was running without remote. It was made operational by manually with temporary solution and we paid the entire amount . It was promised that RC to be returned on 19th June, 2014 but inspite of repeated calls, no action had been taken by the service centre. On 21st June, I had to visit the service centre to collect the Remote Control. We paid Rs. 350/- as per the Bill No. 4845. But, the remote was not working while I checked it with my TV and reported the problem instantly to the Service centre.
    Ultimately, on 1st July 2014, the main PCB with Remote (Hand) taken back by the Technician of CYBORG for servicing it again and after repeated follow-up , they reported that IC of Remote Control has to be replaced . In the meantime, I requested them for a TV temporarily to watch the World Cup Football. But they were unable to keep our request.
    On 13th July, 2014 CYBORG Engineer attended and made the TV Set operational and charged Rs. 850/- for the cost of IC of the Remote Control and we paid the same which is mentioned in Bill No. 4845.
    But I am sorry to say, the set was suddenly powered off on 20th July while we were watching it. The complaint was raised to CYBORG but after repeated calls, one Technician came on 25th July, 2014. His remark was as written, Quote “ Attende But TV Set is Dead. Call back to Service Center” Unquote. As a Technician, he was unable to resolve the problem on the spot .
    I have called the Service centre several times. Every time they are telling Technician will visit to check the TV but all are falls statement what I can understand now.
    In this circumstances , please suggest what is to be done at our end. I have already spent Rs. 4400/- from January to July, 2014 for this old CRT TV.

    I am briefing my case, pls let me know whether I can file the case

    I am senthilkumar from Bangalore. I bought a Insurance Policy ( unit linked )from a well known international company in the year 2004 for 10 years. Paid all my premiums on time till now.( Rs.15000 Yearly for 10 Years ) my policy is getting maturity by Dec2014. ( During Purchase they said I will get aroudn Rs.13 lak after 10 years, again in 2010 they said, you wont get 13 lak, but atleast least value of Rs.4.5 lak )

    But got a Letter from the Insurance Company ( letter dated 20th May 2014 ) stating that Rs.3.66 laks is your current value after adding Loyalty bonus.

    Hence I thought of surrendering the policy before. Hence went to Local branch( 23rd june) with all documents for surrendering .

    I was shocked because they told the final value as on 23rd June was Rs.2.08 lak.

    Then I showed the letter what I received, then they said to give two days time to revert, Then they reverted over phone saying that fund value is only 2.08 lak.

    Then I raised the complaint via Email to the insurance company on 26th June. They took lot of time to revert, inspite of frequent follow up

    Meanwhile I sent a letter on 06.08.2014 with all the facts, but they said the amount mentioned on 20th may was wrong sent from their side, and the actual value is around 2.08 lak only ( as on 23rd June )

    Then I said will go to consumer forum, again they asked time to revert, inspite of several follow up , again yesterday they confirmed that the final value will be 2.3 lak as on 18th Sep 2014 orally.

    As a internationally reputed firm, they cannot say it was an error sending a computerised Letter to a client.

    Hence I thougth of proceeding towards legally. Can you pls let me know whether I can go to consumer forum to claim Rs.3.66 lak stated in their old letter ( which was said as wrong Value later ) . Thought of claiming Rs.1 lak additional for mental agony too.

    Pls advise me to proceed further

    Thanks for lot for giving information on Consumer Complaints and how to file the case in consumer court.

    This is a summary of problem faced by me regarding my Xolo Phone Q1100 which I bought on 31.03.14

    The first issue was a dead phone.28.08.14

    The second was the body damages post mishandling by the service center.

    Then whole body was replaced.

    The third was after replacing the body, speaker, headphone, continuous reboot, calls, etc.20.09.14

    Then they sent a replaced handset(refurbished or old) of which I was not happy and told Monika and Ashish(xolo custumer service) about it. yesterday 04-10-14. I asked them to give me a new handset or refund me the money. As I was worried that this phone will have some issues too.

    The fourth, got a home delivery form Xolo Service Center with the replaced handset. While check the handset found the same old problems which I had previously. 04.10.14

    I have not collected the handset and the delivery guys Vivek has seen and check for the same problem and has taken the handset back to service center.

    I have been mailing regarding this to the CEo Vishal Seghal from the begining.

    The customer service People Monika, Ashish, Mahesh, Ashu…. are all saying they wont give me a new handset or refund, they will try and repair.

    I have lost faith in these people that they are going to be any help regrading my phone as the replaced handset was old and and refurbised.

    Please guide me how I can take my case to Consumer court

    Hello Sir
    I wish to file a complaint against ICICI Bank for their atrocities they committed during “Debt Collection Procedure”. Owing to have suffered huge losses in my business and physical ailment (I am 62 year old and a patient suffering from Heart ailment as well as a Diabetic, remaining jobless for almost five years), I was unable to pay my credit card dues. When I sought an ‘One time settlement’, the bank staff hurled nastiest abuses at me. Even after writing to Customer care and in spite of sending a reminder, the bank took no notice to my grievances. They had sent executives(as they say) at my residence without any letter of authority from the bank and committed nuisance during my absence and insulted my wife. The executive even wanted to force himself inside my residence during my absence. He also stealthily collected my neighbor’s mobile number and started harassing her. I complained to the Ombudsman to which the bank denied all my allegations. The bank had also sent their staff to snoop upon my wife’s movement and after securing her office number and her mobile number, they started harassing her intruding into her privacy, where she is no way connected with the debt.

    Does such case lie under the jurisdiction of the Consumer forum? The bank, so far have flouted all the norms which have been imposed upon them by the Reserve Bank of India in terms of ‘Debt Collection Process’. I have witnesses to prove their atrocities, NC complaint filed at Police station and not all but certain ‘Call Recordings’. In this case, am I eligible to lodge a complaint?

    Sir, I purchase a Karbonn smartphone on 30.8.2013for Rs, 10599.
    This was done in mumbai, and bill is in my husband’s name, though I made the payment tbrough my credit card.
    The wi_fi function began to malfunctiond, on 14.8.2014 i. e. within a year, and as the warranty was still valid, i gave it for repair at the authorised center.
    The instrument was returned back to me, after more than a month, unrepaired. I resubmitted it for repair,.
    Though it is now more than two months, the instrument has not yet been returned to me.
    Is this a suitable case for the consumer forum?
    Can I file a complaint, or will my husband have to be the complainant?

    I was using MTS netconnect. They offer speed upto 9.1mbps. In the month of Nov and Dec i got very poor services, i made many complaints about speed.

    The company have technical issues more than a month in my area(green field Colony, faridabad 121002) and they admit it.

    In reply of speed issue they said they have some technical issues in that particular area and they have no updates about resolution time. This were happen more than a month. Then i asked them for bill wavier of Nov-dec month. They asked me to send a request through email to customercare@MTSIndia.in. i wrote first mail about this on 19th Dec 2014 after bill generation.

    Besides resolving issue the executive give me suggestion to convert on prepaid or opt lower plan.
    They ask me to pay full bill only for an active connection, they are not bothered about services.
    They always send my feedback to concern team but this team never contact me.
    My due date of bill payment is 3rd Jan 2015. i informed them many times but they do not resolve the bill related issue.

    The executive also raised a connection cancellation request(1183424) without my permission.

    Now on 9th Jan 2015 they barred my connection and call me to pay due amount. Initially i told them the full story and they replied that “We forward your concern to the concerning team”. Every day they call me for the payment but didn’t resolve the issue.

    On Jan 2015 i received a mail from Mrs. Simran form MTS about payment reminder and clarification. i contact her and send her all the previous e mail conversation. After many calls one day she answer that she send my case to another authority.

    Now i don’t understand what should i do. I also complaint on CORE, but didn’t get any response.

    Dear Sir, I am a regular customer of HP gas. On 10 th of Feb Because of change in job place I had requested My Agency to shift my account to another agency. My Consumer no with HP was 544848.My earlier aacount was with Shreya Gas agency in Rangareddy district of Andhra Pradesh. And I requested to transfer it to Vidya nagar gas company in Hyderabad. On day I requested the transfer I got authentication code for transfer i.e.D5UIZQUX. But the transfer is not yet done.I called HP gas helpline no as per them the transfer should happen within 48 hours of time. But its more than a week time passed and nothing yet happened.Kindly guide. How to go ahead with Filing Consumer court case. Is Email/ online complaint valid for consumer court.

    Dear Shri Gupta,

    After final argument , I had to inform my advocate that he is no more to represent me . Nor the judgement is to be pronounced on 1-7-15 .

    Is the advocate’s presence required at the time of pronouncing the judgement ? I am the CA of the complainant and if any clarification is sought by the bench am I entitled to give the same ? I am not in a position to trust te advocate.

    ( I am an ex-scientist of BARC and retired long back. I would like to engage in social service activities of the type you are engaged with. Could I associate with you in some way ?)

    Dear Sir,
    A realtor M/s Aditya Construction Company India (P) Ltd having its office in Hyderabad has started many housing projects in various parts of Hyderabad. By releasing huge advertisements, they enticed many buyers promising luxury apartments with world class amenities and collected premium rates (50% more than prevailing rates in the neighbourhood. Many of the buyers are NRIs. The Company used to send a letter/mail showing exterior picture of the building stating that the construction is as per schedule and collected instalments. When some of buyers want to see the flat they didnot allow them quoting safety norms and other reasons. The project where I bought a flat is supposed to be completed (including Grace Period of Nine Months) on or before Dec2014. They also didnot deliver the flats in other projects. They are not responding to any queries and not attending to us in person. What are the legal means available? The directors of the company would have grabbed hundreds of crores and leaving the buyers. Some buyers are putting additional amounts to get the unfinished works completed in their flats. Since many buyers are NRIs, it is difficult to gather collective voice as the realtor is not sharing their addresses. How can we make them to complete the projects and deliver the flats as promised. Or, How can we book such defaulters and recover hundreds of crores looted by directors of the company.

    Sub- Regarding fraud transaction of my SBI credit card : 4726xxxxxxx on 1 Aug 2015
    I am using SBI card 472xxxxxxxxxx(Gold and more card) and on 1-08-2015 ,I got call from +91-8506863703 / +91-8527653862 and he told he is Manoj Kumar from SBI and as you have complain to close sbi card, so we are upgrading your card to signature card without any fee. I refused, still he insisted and told we were from SBI and SBI is upgrading your card to provide you better service.
    (As already 22-07-2015 I called to SBI customer care and told to close my SBI card , executive was talking me and after that he put on call hold for more than 40 minute and finally call get disconnected. Again 23-07-2015 I called to SBI customer care and told them to do the same , she told they will resolve all his problem as I have to remove my office address and update as my home address for the same.) So I agreed to upgrade my card.
    He(Manoj Kumar) told ,for upgradation of my card I need to give credit card along with one photo and copy of id proof to executive and instruct me to make sure you should cut your card before handover to executive and fill the SBI form.
    Sbi executive come at my home location and he given me the sbi form and asked me to fill it and I refused , he told you just signature in applicant signature in form , that other detail we will get from system and will fill the form and after 2 days you will get verification call from SBI. I gave him one photo and copy of id proof(Adhar card) and cut the card , properly scratch CVV and scratch multiple time the black magnetic strip of the card and handover him.
    Evening 7.05 pm I get sms on my registered mobile (+91-8826518980) “Transaction of Rs. 95,500.00 SBI credit card XX0879 at SKY LIGHT ELECTRONICS on 1 Aug 15.” I neither get OTP nor havn’t share the credit card pin to anybody. Again 7.07 pm , I get sms on my mobile phone “Transaction of Rs. 32,500.00 SBI credit card XX0879 at BLUE BIRD TRDING CO on 1 Aug 15.”
    Even after that I get sms your available limit is RS 0.0 and after that get declined sms at 7.08 pm “Dear sbi cardholder, txn of Rs. 30,000 on card ending with XX0879 at BLUE BIRD TRDING CO has been declined due to insufficient credit limit on 01-08-15.” And again sms 7.09 pm “Dear sbi cardholder, txn of Rs. 25,800 on card ending with XX0879 at BLUE BIRD TRDING CO has been declined due to insufficient credit limit on 01-08-15.”
    After that I call to SBI customer care (012439020202) on same day (01-08-2015) and blocked the card ref no(1-246182064).Customer care executive told after 24 hr updating the transactions, you can call us and we can proceed further.
    Concern-
    • As there are multiple transactions as well as declined transaction at same time using my card, please decline all the transaction as I never did the same. And reset my credit card balance.
    • My credit limit was1,27,000 INR while transaction was for 1,28,000 INR It should be stooped as credit limit is over.
    • I neither get OTP nor haven’t shared the credit card pin to anybody for these transaction.
    • I have raised the dispute to SBI card they have put it Non recipient of Non- receipt Goods/ services rather than as fraudulent transaction.
    • Complain raised to Cyber cell Gurgaon-1123/03-aug-2015
    • As this transaction is more than 30,000 merchant should have my ID. And in merchant copy ,Customer signature are fake,
    • Bank is harassing me and forcing for recovery and warn me to siege my SBI saving account rather than recovery from the merchant as these is fraudulent transaction.

    Sir, I has purchased HP laptop about two years ago. However in last two years, after every 3-4 months there is issue in performance of laptop. Twice hard disk has crashed and both the time, it was crashed when HP customer service dept. had taken remote access for attending to repairing complaint. I am fed up with this issues and have requested to replace machine since it is not performing properly and has not served my purpose for which i have purchase. My entire data is at risk. HP has refused to replace machine. Now I want to lodge complaint with Consumer court. Request me to advice whether consumer court can be approached.

    Sir,i Purchased HP slate 7 voice tab in december 2014 and warranty is till 5th february 2016.Problem aroused in my tab from june 2015,till now 1 time some “required setting is done/software updated” 3 times motherboard is changed and 1 time battery is changed.Last time motherboard and battery is changed in january 2016,but problem is still there.
    this time on battery there was a sticker of my original product and under that there is some other sitcker,i checked serial no.of that sticker(not of my original one) and it’s warranty is showing expired on HP official site.So i want to know whether it is fraudulent done by HP as they are using used product in my tab,and am i eligible to file a case in consumer forum ? Please sir,reply as early as possible.

    I am Jaideep Joseph, I would like to start by thanking you for putting up an excellent website on helping people with consumer complaints.

    I am struggling with QUIKR Doorsteps (e-commerce). I sold my used Air Conditioner through QUIKR Doorsteps, the QUIKR Doorsteps team came to pick up the AC from my place and delivered it to the buyer who made a payment to the QUIKR portal online. I was told was by Quikr team that the payment willbe credited in my bank account within 48 hours. This was on April 21, 2016. I haven’t received my payment yet. I have written multiple emails and made uncountable phone calls to the QUIKR Doorstep Customer Care number but sadly I have not received the payment.

    I have spoken and written to the senior management staff in the call center but every time I get false promises of payment being credited the next day.

    Binoy sir, please help and guide me to file a compliant against QUIKR DOORSTEPS in consumer court. It has cost me a great deal of emotional trauma and frustration.

    I read your article ‘How to prepare and submit a Complaint to a Consumer Forum’ and found it very helpful.
    I have following querries:
    1. What is the stamp value for afirmation?
    2. I live in Gurgaon (Haryana) and my opposite party is in New Delhi. In which jurisdiction do I buy stamp/ stamp paper from?
    3. Do I have to submit to the court that complaint is filed under so & so clause of the law to make my case admissible? if yes, what are the clauses and where can I find them?
    4. I and my son (NRI) has identical disputes against the same party. Do we have to file separate complaints or one complaint? I have a GPA from my son. Is the good enough authorisation to file and represent case on his behalf?
